LULL Guardian Terms of Access FOR ATTORNEY REVIEW AND APPROVAL

These Guardian Terms govern the access and use of the Lull guardian dashboard and consent system by parents, legal guardians, and other authorized adults connected to a Lull user account. By creating a guardian account, completing the guardian consent process, or accessing any guardian feature of the Service, you agree to these terms.

1. WHO MAY BE A GUARDIAN

Guardian access is available to the following persons:

• Parents or legal guardians of a Lull user under 18 years of age — consumer channel
• Adults designated as trusted contacts by Lull users 18 years of age or older — with the user's explicit consent — consumer channel
• Parents or legal guardians of a student enrolled through a school licensing agreement — school channel consent system

Guardian access may NOT be created by or provided to:

• Individuals who have not received a valid Connect Code from the associated Lull user (consumer channel) or who have not been designated as the student's guardian by the school (school channel)
• Individuals who are not the legal parent, guardian, or explicitly designated trusted contact of the user
• Any person for the purpose of monitoring a user without that user's knowledge
• Teachers, administrators, or school staff (school staff access is provided through the Counselor or Administrator account type, not through the Guardian access system)

2. TWO TYPES OF GUARDIAN ACCESS

Lull provides two distinct types of guardian access with different features and purposes:

2.1 Consumer Guardian Dashboard — What Is Visible

The consumer guardian dashboard provides read-only access to the following aggregate information only:

• Journaling activity frequency and patterns (how often the user journals, not when or what)
• Emotional theme categories (general topic areas such as 'friendship' or 'academic stress' — not specific content)
• Safety notification alerts at defined threshold levels
• Account activity status (active / inactive)

2.2 Consumer Guardian Dashboard — What Is NOT Visible

2.3 School Channel Guardian — What Is Provided

Guardians who complete the school-channel consent process receive:

• A confirmation page showing that consent has been recorded
• A confirmation email confirming the student account is approved
• A permanent record of their consent that can be accessed by contacting [email protected]

School-channel guardians do NOT receive: ongoing access to a live dashboard; access to student journal content; safety notification alerts (school-context safety alerts go to the assigned school counselor, not to the guardian). If a school counselor determines that guardian notification is appropriate following a safety alert, the counselor makes that determination and contact independently under their professional obligations.

2.4 Safety Notifications — Consumer Channel

Consumer guardians connected to users under 18 may receive safety notifications when the Company's automated safety detection system identifies content at defined threshold levels. These notifications:

• Describe only the general nature of the concern — not the specific content, quotes, or language used
• Are not clinical assessments or diagnoses
• Are not mandated reports
• Are automated signals designed to prompt a caring check-in
• Should be responded to with warmth and openness, not with confrontation or demands to see the journal

3. GUARDIAN CONSENT PROCESS — SCHOOL CHANNEL

3.1 Consent Request

When a student is enrolled in Lull through a school licensing agreement, a consent request will be sent to the guardian email address provided by the school. The consent request is delivered by email, or by SMS if a phone number is provided, and contains a secure single-use link valid for 72 hours.

3.2 What You Are Consenting To

By completing the guardian consent process, you are consenting to:

• The creation and activation of your child's Lull student account at the named school
• The collection of your child's journal entry content for the purpose of providing the Lull journaling service
• The use of Lull's safety detection system to monitor for language suggesting your child may be in danger
• The sharing of specific conversation content with your child's assigned school counselor under the defined safety threshold conditions described in the Terms of Service and Privacy Policy
• The terms and conditions set forth in all five documents presented during the consent process: Terms of Service, Privacy Policy, COPPA Compliance Statement, Guardian Terms, and School Data Processing Agreement

3.3 What You Are Not Consenting To

Guardian consent in the school channel does NOT constitute consent to:

• Your ongoing access to your child's journal content (school-channel guardians do not receive dashboard access)
• The sharing of your child's journal content with you personally — journal content in the school channel is shared only with the assigned school counselor under defined conditions
• Any use of your child's data beyond the educational purpose described in the school's DPA

3.4 Consent Records

Your consent record includes: the date and time of consent, your IP address at the time of consent, your typed digital signature, the list of documents you acknowledged, and the version of the disclosure presented to you. This record is maintained permanently as legal documentation of your informed consent.

3.5 Consent Revocation

You may revoke your consent at any time by contacting [email protected]. Revocation of consent will result in your child's account being deactivated within 5 business days. Revocation does not delete consent records already created, and counselors may retain access to alerts that were created prior to revocation per the school's DPA terms.

4. GUARDIAN OBLIGATIONS — CONSUMER CHANNEL

By creating a consumer guardian account, you agree to:

• Use the guardian dashboard solely for the purpose of supporting the wellbeing of the connected user.
• Not share, publish, screenshot, or otherwise distribute any information visible on the guardian dashboard to any unauthorized third party.
• Not use dashboard information to confront, interrogate, or pressure the connected user about specific journal content (which you cannot see).
• Respect that the confidentiality of the journaling experience is essential to its effectiveness. Directly referencing guardian dashboard observations may undermine the user's trust in the product and their willingness to journal honestly.
• Not attempt to access journal content through any means including legal process, technical circumvention, or coercion of the user.
• Notify Rhetoric Innovations LLC immediately at [email protected] if you believe the guardian account has been accessed by an unauthorized person.

5. GUARDIAN ACCOUNT CONNECTION AND DISCONNECTION — CONSUMER CHANNEL

5.1 Connection Process

Consumer guardian accounts are connected using a unique Connect Code provided by the Lull user. The user is notified immediately when a guardian account is connected. Connection constitutes the user's consent to guardian dashboard access.

5.2 Disconnection by User

Users 18 and older may disconnect a guardian account at any time through account settings without notice to the guardian. Users under 13 may not disconnect guardian accounts established through the parental consent process. Users ages 13-17 may request disconnection through [email protected].

5.3 Disconnection by Guardian

Guardians may close their guardian account at any time through guardian account settings. Disconnection does not affect the associated user's account or journal data.

5.4 Disconnection by Company

The Company reserves the right to disconnect a guardian account if the guardian violates these Guardian Terms, particularly if the guardian uses dashboard access in a manner that appears intended to harm or surveil the user.

6. LIMITATIONS OF THE GUARDIAN DASHBOARD

The guardian dashboard is a supplement to, not a substitute for, direct communication with the user and professional support when needed. If you have concerns about your child's wellbeing, please seek appropriate professional guidance rather than relying solely on the guardian dashboard.

7. PRIVACY OF GUARDIAN INFORMATION

Guardian account information is subject to our Privacy Policy available at lulljournal.app/privacy. Guardian email addresses, digital signatures, and consent records are stored securely. Consent records are not shared with third parties except as required by law. Guardian email addresses may be used to send consent-related communications and safety notifications as described in these terms.

8. GOVERNING LAW

These Guardian Terms are governed by the laws of the State of Missouri. Disputes arising from these terms shall be resolved in accordance with the dispute resolution provisions of the Lull Terms of Service.

9. CHANGES TO THESE TERMS

We may update these Guardian Terms periodically. Material changes will be communicated by email to registered guardian email addresses. Your continued use of guardian features after the effective date of changes constitutes acceptance of the updated terms.
